• Do not constitute a binding contract until a signed agreement and deposit are received

5. Project Agreements

All work performed by the Company requires:

• A signed project agreement or written approval from the client
• A deposit payment before fabrication or work begins

Project timelines are estimates and may vary based on material availability, supplier lead times, and scheduling constraints. The Company will make reasonable efforts to communicate delays in a timely manner.

6. Payment Terms

• Deposits are required before fabrication begins and are non-refundable once work has commenced
• Full payment terms will be outlined in the individual project agreement
• Late or outstanding payments may result in project delays or suspension of work
• Additional fees may apply for late payments as specified in the project agreement

7. Limitation of Liability

To the fullest extent permitted by applicable law:

• Down East Fabrication, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or website
• Our total liability to any client shall not exceed the total amount paid by that client for the specific services giving rise to the claim
• We are not responsible for damages resulting from misuse, improper installation by third parties, or failure to follow care instructions

8. Warranties Disclaimer

All services are provided "as is" and "as available" unless otherwise expressly specified in a written agreement. We do not guarantee:

• Exact color, veining, or pattern matching in natural stone materials, as these are inherent characteristics of natural products
• Performance beyond applicable manufacturer warranties for materials used
• Specific outcomes not expressly stated in the project agreement

9. Intellectual Property

All content on this website, including but not limited to text, images, graphics, logos, design elements, and layout, is the exclusive property of DOWN EAST FABRICATION, INC. and is protected by applicable copyright and intellectual property laws.
